SF 4: Public Records - Electronic Mail

         SF 4 would allow public officials or employees to delete certain types of electronic mail (e-mail), called transitory e-mail, after its purpose has been served.
         Transitory e-mail was defined as e-mail sent or received by an official or employee of a public office that is a public record but that informally communicates temporary administrative information and does not set policies, guidelines or procedures, certify transaction of public business or constitute a receipt. Examples of transitory e-mail would be preliminary discussion of meeting scheduling, routine office announcements, and other informal messages.
         Generally, public records of the state must be maintained for at least ten years, and officials may deviate from this rule only with explicit approval of the Records Committee. However, under the provisions of SF 4, a state official or employee would be allowed to delete transitory e-mail as soon as its purpose had been served.
         Supporters of SF 4 maintained that it was a common sense approach to manage the volume of e-mail that has no enduring value.
         Opponents, including the Wyoming Press Association and the League of Women Voters, worried that the law was too broad, and argued that information that seemed unimportant now might become important in the future.
         The Senate passed SF 4 unanimously.
         The House Rules Committee defeated SF 4, on a 6-7 vote. The following votes are the House Rules Committee votes. A YES vote means the representative wanted to allow public officials and employees to delete e-mail after they decided its purpose had been served. A NO vote means the representative did not want to allow public officials and employees to delete e-mail.
