HJ 1: State Legislative Stabilization Reserve Accounts

House Joint Resolution 1 (HJ 1) would have submitted a proposal to Wyoming voters to amend the Wyoming Constitution. The proposed constitutional amendment would have allowed the legislature to establish special accounts from which money could only be withdrawn upon a two-thirds majority vote of all members of the Senate and House, voting separately.
        
This proposed constitutional amendment would have appeared on the 2006 general election ballot, and would have had to be approved by a majority of voters who vote in that election to be adopted.
        
Supporters of HJ 1 believed that the Legislature needs a true "rainy day fund". Supporters noted that right now, legislators have only two choices for setting money aside, the Wyoming Permanent Mineral Trust Fund (WPMTF) and the budget reserve account (BRA). When money is deposited into the WPMTF, it can never be withdrawn, and only the interest generated by the account may be spent. On the other hand, money in the BRA can be spent whenever a simple majority of senators and representatives agree to do so.
        
Proponents of the state legislative stabilization reserve account wanted an additional option in between the WPMTF and the BRA: a fund in which money could be saved during times of high revenue (such as now, when the state is experiencing very high mineral revenue), but from money could be withdrawn when the state is bringing in less revenue. Requiring a super-majority vote of the Legislature to withdraw from the account would help ensure that the Legislature would only spend the funds on serious state needs during times of less revenue.
        
Opponents of HJ 1 preferred to allow the Legislature to appropriate state money by simple majority, or to permanently save it in the WPMTF, and did not see a need to set up another type of legislative savings account.
        
HJ 1 failed the vote for introduction in the House, 21-38 (1 excused). The votes listed below are the House votes for introduction. A YES vote means the representative wanted to consider a constitutional amendment to allow the Legislature to establish special savings accounts from which money could only be withdrawn upon a two-thirds majority vote of the Legislature. A NO vote means the representative did not wish to consider such a constitutional amendment.
