HB 63: Public Works Contracts - Resident Preferences - 2

HB 63 would have changed the statutory definition of resident as it relates to the preference given to resident contractors who bid on public works projects in the state. Public works contracts must be awarded to the lowest bidder, with a 5% preference given to resident contractors, which means that resident contractors may be awarded a bid if their bid is up to 5% more than the lowest bid.
        
The change proposed in HB 63 would have allowed larger contracting businesses that work in Wyoming but are owned by out-of-state entities to receive the same 5% preference on bids, as long as the company had maintained an office and place of business in Wyoming for at least one year before submitting the bid.
        
HB 63 also would have changed the amount of work on a project that a successful resident bidder may subcontract to nonresident contractors from 20% in current statute to 50% of the project work.
        
Supporters of HB 63 argued that, with the boom in school construction we are presently experiencing in Wyoming, bidding would be more competitive with a larger pool of qualified resident contractors, which would benefit the state and its taxpayers. They also noted that regional contracting companies are more often union companies that pay higher wages and better benefits than nonunion companies, which benefits workers and local economies where the projects are located. Supporters also favored raising the subcontracting limit, noting that specialty subcontractors (such as masonry) often comprise more than 20% of the total work of the project.
        
Opponents of HB 63 worried that the bill might harm smaller in-state contracting companies.
        
The House amended the subcontracting limit back down to 30% of the project work, with the further specification that the subcontracting limit would drop back to 20% in 2009. Thus amended, the House passed HB 63 on third reading (final vote), 45-14 (1 excused).
        
The Senate defeated HB 63 on third reading, on a 15-15 tie vote.
        
The votes listed below are the House and Senate third reading votes. A YES vote means the legislator wanted to expand the definition of resident contractors who would qualify for the 5% bid preference on public works projects. A NO vote means the legislator did not want to expand the resident contractor pool.
