HB 48: Harassment, Intimidation or Bullying Provision

         HB 48 would have required all school districts to develop policies that forbid bullying, intimidation or harassment in K-12 classrooms. Districts would have had to establish procedures for students and teachers to report problems, and specify how they would address the issues whenever they arose. Districts would have been encouraged to establish anti-bullying teams, composed of students, staff and parents, to promote safe and positive school environments.
         Harassment, intimidation or bullying would have included any intentional gesture or an intentional written, verbal or physical act or threat that would harm a student, damage a student's property, or cause a student reasonably to fear harm or property damage. Any such acts that are severe, persistent or pervasive enough to create an intimidating, threatening, or abusive educational environment for a student would have qualified.
         Supporters of HB 48 noted that a safe and civil school environment is absolutely necessary for students to learn and perform well in school. They noted that refusing to tolerate harassment, intimidation or bullying is necessary to provide students with a safe and non-threatening environment at school.
         Opposition to the bill was minimal, with some concern about whether the bill might go too far or be too heavy-handed.
         The House passed HB 48, 54-5 (1 excused). The Senate did not consider the bill in the Committee of the Whole by the deadline for action, which killed the bill.
         The votes listed below are the House third reading (final passage) votes. A YES vote means the representative wanted to require school districts to develop policies to prohibit bullying, intimidation or harassment of K-12 students at school, while a NO vote means the representative did not support this requirement of Wyoming school districts.
