HB 45: State Legislative Stabilization Reserve Account

HB 45 was brought as a companion bill to House Joint Resolution 1 (HJR1), which proposed a constitutional amendment to permit the creation of special savings accounts from which money could only be spent upon a two-thirds affirmative vote of each house of the Legislature (the House and the Senate) voting separately.
        
If HJR1 passes the Legislature, and if it is approved by Wyoming voters in the 2006 general election, then HB 45 would create such an account, called the state legislative stabilization reserve account number one. Funds in the account would be invested by the state treasurer to obtain the highest possible return while preserving the corpus of the account. The corpus could only be spent if two-thirds of the House and Senate voted to do so, but the investment income would go into the general fund.
        
Supporters of HJR1 and HB 45 believed that the Legislature needs a true "rainy day fund". Supporters noted that right now, legislators have only two choices for setting money aside, the Wyoming Permanent Mineral Trust Fund (WPMTF) and the budget reserve account (BRA). When money is deposited into the WPMTF, it can never be withdrawn, and only the interest generated by the account may be spent. On the other hand, money in the BRA can be spent whenever a simple majority of senators and representatives agree to do so.
        
Proponents of the state legislative stabilization reserve account wanted an additional option in between the WPMTF and the BRA: a fund in which money could be saved during times of high revenue (such as now, when the state is experiencing very high mineral revenue), but from money could be withdrawn when the state is bringing in less revenue. Requiring a super-majority vote of the Legislature to withdraw from the account would help ensure that the Legislature would only spend the funds on serious state needs during times of less revenue.
        
HB 45 failed the vote for introduction in the House, 29-30 (1 excused). The votes listed below are the House introduction votes. A YES vote means the representative wanted to consider setting up a special savings account from which the Legislature could only withdraw funds upon a two-thirds majority vote. A NO vote means the representative did not want to consider the bill.
